We were approached by a client that had employed solicitors to issue litigation proceedings against a debtor who owed in excess of £50,000. The whole process cost our client £16,000. Unfortunately the court order to pay was returned from the address marked “no longer at this address”. As a result the solicitors stopped all further action as they were unable to locate the debtor. Our role was to find the debtor on our client’s behalf. We investigated the case fully and found that the debtor had links with another company (company B) whose registered office was an accountant’s. Although the accountants were not prepared to disclose the whereabouts of the debtor we were sure that his connection to this company would eventually lead us to him. We therefore decided to investigate the director of company B and visited them to make enquiries. On doing so we came across a residence that was being refurbished. After we had made some enquiries it was obvious to us that our missing debtor was indeed refurbishing a premise linked to Company B with a view to living there in the future. We visited the premise and took photographic evidence of the person residing there. Our client confirmed that the photographed person was indeed the debtor that had absconded. Consequently our client then instructed his solicitors to complete the works that he had paid for.

Many creditors believe that once they have instructed a solicitor to obtain monies, and indeed are awarded a court judgement for payment, that their debtors will pay. Unfortunately this is quite often not the case. The cost of doing so can be quite substantial and the whole process extremely frustrating. This obviously makes our role more challenging as the debtor may have off loaded their assets, be processing their company into administration or has filed for liquidation.
